This is a courtesy translation. In case of any discrepancy, the German version of this document is the legally binding one.
Terms of service
1. Scope
The following terms apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers in Germany, Austria, Belgium, the Netherlands, Luxembourg and Switzerland.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person, or a partnership with legal capacity, acting in the exercise of their trade, business or profession when entering into a legal transaction.
2. Contracting party, conclusion of contract, correction options
The purchase contract is concluded with Bitminer24 GbR, Fetzerstraße 9, 70199 Stuttgart, Germany.
The presentation of products in our online shop does not constitute a legally binding offer but an invitation to order. You can first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order, using the correction aids provided during the order process.
By clicking the order button "buy now" you submit a binding offer to conclude a purchase contract. Receipt of your order is confirmed immediately by email. That acknowledgement of receipt does not yet constitute acceptance of your offer. The purchase contract is concluded as soon as we accept your order by an express declaration of acceptance or by the shipping confirmation, at the latest when the goods are dispatched.
Note for consumers in Switzerland: the provisions of the Swiss Code of Obligations (OR) apply to the conclusion of the contract.
3. Contract language, storage of the contract text
Language available for concluding the contract: German
We store the contract text and send you the order details and our terms of service in text form. You cannot retrieve the contract text directly through the website after the contract is concluded.
Note for consumers in Switzerland: your data is stored and processed in accordance with the Swiss Data Protection Act (DSG).
4. Delivery terms
We ship the products to the delivery address given during the order process.
We deliver by carrier only. Collection in person is unfortunately not possible. We do not deliver to parcel lockers.
Note for consumers in Switzerland: please note that deliveries to Switzerland may incur customs duties and import charges, which are borne by the customer.
5. Payment
5.1 Prices
The prices shown at the time of the order apply. They are total prices and include statutory VAT. Prices are quoted in euros only. We do not accept payments in Swiss francs (CHF).
5.2 Payment methods
The following payment methods are available in our shop:
- PayPal: to pay the invoice amount through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate with your credentials and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed.
- Credit and debit cards (processed through PayPal): payment by the usual credit and debit cards (VISA, Mastercard, American Express) is handled exclusively through PayPal's payment interface. A PayPal account is not required. You can pay as a guest with your card number. PayPal processes the card data.
- Klarna: in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer the following payment options: pay by invoice and pay in instalments. Payment is made to Klarna in each case. Klarna carries out a credit check before providing a payment option. Further information and Klarna's terms of use are available at www.klarna.com. 6. Warranty and guarantees
6.1 Liability for defects
The statutory liability for defects applies.
Note for consumers in Switzerland: for consumers habitually resident in Switzerland, the statutory warranty period of two years under art. 210 para. 1 of the Swiss Code of Obligations (OR) applies.
6.2 Guarantees and customer service
Information on any additional guarantees that may apply, and their exact terms, can be found with the individual product and on dedicated information pages in the online shop.
7. Dispute resolution
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body.
8. Product description and hardware basis
(1) For the purposes of this contract, "NerdMiner V2" denotes an open source firmware for bitcoin solo mining under the GNU General Public License v3.0, developed by the NerdMiner_v2 open source project. The firmware runs on commercially available microcontroller hardware based on the ESP32-S3 chip from Espressif Systems.
(2) We supply the NerdMiner V2 as a complete package consisting of an ESP32-S3 based hardware board with integrated display (typically the LILYGO T-Display S3 made by LILYGO Co., Ltd.) and the NerdMiner V2 firmware preinstalled in its current version. Depending on availability, the hardware component may come from comparable ESP32-S3 boards by other manufacturers, provided the specifications stated in the product data sheet are met (in particular the hash rate range of 78 to 250 KH/s, OLED display, USB-C connector and power draw under 1 watt).
(3) The designation "NerdMiner V2" expressly refers to the software and firmware configuration, not to a particular hardware manufacturer. Markings on the board, the housing or the device itself that indicate the hardware manufacturer (for example "LILYGO", "T-Display S3" or comparable designations) do not constitute a defect within the meaning of § 434 BGB (German Civil Code), provided the device meets the assured functional specifications.
9. Notes on bitcoin solo mining
(1) The Nerdminer V2 is bitcoin solo mining hardware. Solo mining is based on a probabilistic consensus mechanism (proof of work). At the hash rate of the Nerdminer V2, the statistical probability of finding a bitcoin block is very low.
(2) The purchase price relates exclusively to the value of the hardware device and the preconfiguration it includes. The buyer has no contractual claim to finding a block or to any particular mining yield.
(3) The block rewards named in our product communication (3.125 BTC, approx. 190,000 €) are factual statements about the current bitcoin block reward under the bitcoin protocol and are subject to the volatility of the bitcoin price. They do not constitute any assurance of proceeds for the buyer.
(4) The Nerdminer V2 is bitcoin solo mining hardware for the buyer's own participation in the bitcoin network. It is not a financial instrument and not an investment within the meaning of the KWG (German Banking Act) or the MiCA regulation. bitminer24 provides the hardware only; the buyer's mining activity after delivery is carried out independently and at their own responsibility.
